Fundamental Guidelines
“The Rental Agreement encompasses the terms and conditions, alongside the rental document delineating hire details, which is provided with each vehicle at the point of hire and is denoted as the ‘Rental Document’ in these terms and conditions. Prior to submitting your Booking Request, kindly ensure the completeness and accuracy of the details outlined in these terms and conditions, and confirm your agreement. The act of submitting a Booking Request is tantamount to accepting these terms. We retain the prerogative to modify these Terms at any time, with immediate effect upon publication on the Website, in the brochure, at the Sites, or through other forms of communication.
The Rental Agreement is a contractual arrangement between 4BOX4 Adventure Rentals and the individual and/or company executing the Rental Document (referred to as ‘the hirer’), whose particulars are meticulously documented in the Rental Document. The agreement is hereby established as follows:”
Vehicle Specifications and Rental Duration
The lessor shall permit, and the lessee shall accept, the motor vehicle specified in the Rental Document (herein referred to as ‘the vehicle’) for the duration of the hire period as stipulated in the Rental Document.
Authorized Drivers of the Rental Vehicle
The operation of the vehicle is restricted to individuals listed on the Rental Document or specified in an additional driver’s sheet appended to the Rental Agreement. Furthermore, authorized individuals must possess a valid, full driver’s license pertinent to the vehicle for the duration of its use. Additionally, the vehicle may solely be operated by individuals with a residency in Costa Rica of less than three months. All drivers must be at least 21 years of age or older.
Vehicle Utilization Terms
The hirer is expressly prohibited from:
Utilizing or allowing the vehicle to be used for the transport of passengers for hire or reward, unless the vehicle is hired with t4BOX4 Adventure Rentals explicit knowledge for use in a passenger service.
Subletting or hiring the vehicle to any third party.
Allowing the vehicle to be used outside of their authority.
Operating the vehicle or allowing it to be operated in circumstances that constitute an offense, including but not limited to driving under the influence of alcohol or drugs.
Operating the vehicle or allowing it to be operated in any race, speed test, reliability trial, rally, or contest, or on any race or rally circuit, or in any event as a pace-maker or testing in preparation for any of them.
Operating the vehicle or allowing it to be operated for the transport of more passengers or goods than the maximum specified in the certificate of loading and/or road user charge certificate, whichever is the lesser, for the vehicle.
Driving or allowing the vehicle to be driven by any person if, at the time of driving the vehicle, the driver does not hold a current, full, valid driver’s license appropriate for the vehicle.
Driving or allowing the vehicle to be driven on any roads in bad condition, crossing rivers deeper than 0.5 meters, or on any beach, driveway, or surface likely to damage the vehicle.
Allowing the vehicle to be driven by any person who is not named or described in the Rental Document as a person permitted to drive the vehicle.
Operating the vehicle or allowing it to be operated to propel or tow any other vehicle.
Transporting any animal in the vehicle, with the exception of guide dogs for visually impaired individuals or animals pre-approved by 4BOX4 Adventure Rentals.
Operating or allowing the vehicle to be used in involvement with any illegal activity.
Operating the vehicle to cross bodies of water (rivers, ponds, lakes, oceans, estuaries, etc.). Damages to the vehicle, engine, and electronics caused by water will not be covered by the insurance provider and will be the sole responsibility of the hirer, including all costs associated with vehicle recovery and repair.
Hirer's Responsibilities and Obligations
The hirer is obligated to ensure that:
All reasonable care is exercised when driving and parking the vehicle.
The water/coolant in the vehicle’s radiator and battery is maintained at the proper level.
The oil in the vehicle is maintained at the proper level.
Only the specified fuel type for the vehicle is utilized.
The tires are maintained at their proper pressure.
The vehicle is securely locked at all times when not in use, with keys kept under the hirer’s personal control.
The distance recorder or speedometer is not tampered with.
No part of the engine, transmission, braking, or suspension systems is interfered with.
In the event of an illuminated warning light or if the hirer believes the vehicle requires mechanical attention, they will cease driving and promptly inform 4BOX4 Adventure Rentals.
All drivers authorized to use the vehicle during the hire period are acquainted with and adhere to the terms outlined in the Rental Agreement.
Any authorized driver carries their driver’s license with them in the vehicle at all times and will produce it on demand to any enforcement officer.
Owner's Responsibilities and Commitments
4BOX4 Adventure Rentals is obligated to provide the vehicle in a safe and roadworthy condition, complete with up-to-date DEKRA(Technical Vehicle Inspection) and all other permits required by law
Vehicle Maintenance and Incidents
In the event of an accident, damage, breakdown, or the need for repair or salvage, regardless of the cause, the hirer is required to promptly notify 4BOX4 Adventure Rentals by telephone, providing full details of the circumstances immediately.
The hirer must not arrange or execute any repairs or salvage without explicit authorization from 4BOX4 Adventure Rentals, which includes, but is not limited to, the procurement of a replacement tire. This restriction applies unless repairs or salvage are deemed necessary to prevent further damage to the vehicle or other property.
Complimentary 24-hour Roadside Assistance is provided for all inherent mechanical faults, as determined by 4BOX4 Adventure Rentalsor its authorized repairer, related to the specified vehicle in the Rental Document. For all other roadside assistance pertaining to hirer negligence, such as call-outs for refueling, lost keys, or keys locked in the vehicle, a service fee will be charged.
In the event that the vehicle requires repair or replacement, the decision to furnish the hirer with another vehicle rests solely at the discretion of 4BOX4 Adventure Rentals. If available, a similar vehicle will be provided, or a standard vehicle of the same size/capacity will be supplied if camping-equipped vehicles are not available to replace the damaged vehicle. 4BOX4 Adventure Rentals will not bear responsibility for any expenses other than the hirer’s transportation to the provided replacement vehicle via taxi. 4BOX4 Adventure Rentals shall not be held accountable for costs related to hotel/lodging, meals, or lost bookings/reservations at any point during the rental period.
Vehicle Return Protocol
The hirer is required to, on or before the expiration of the hire term, return the vehicle to the designated rental drop-off location as specified in the Rental Document, during operational hours, or secure 4BOX4 Adventure Rentals explicit consent for an extension of the hire term. In the event of an extension, the hirer is liable for additional hire charges for the extended term.
Failure to adhere to this clause, and failure to promptly return the vehicle, authorizes 4BOX4 Adventure Rentals to report the vehicle as stolen to the Police. In such cases, the hirer is obligated to compensate 4BOX4 Adventure Rentals for either the full cost of the vehicle or all additional costs and losses incurred until the vehicle is recovered by 4BOX4 Adventure Rentals.
Liability and Responsibilities
The hirer assumes liability for:
Any loss of, or damage to, the vehicle and its accessories;
Any consequential damage, loss, or costs incurred by 4BOX4 Adventure Rentals, encompassing salvage costs, loss of ability to re-hire, and loss of revenue;
Any loss of, or damage to, vehicles and property of third parties, occurring during the term of hire.
Insurance Coverage and Provisions
The hirer is informed that motor vehicle insurance is available through 4BOX4 Adventure Rentals. However, the hirer has the option to arrange their own insurance, subject to approval by the owner. Should 4BOX4 Adventure Rentals find the hirer’s insurance coverage not comparable to that offered by 4BOX4 Adventure Rentals, 4BOX4 Adventure Rentals reserves the right to decline the vehicle rental.
If the hirer opts to use their own insurance provider, they assume full responsibility for the complete payment of any damages. In such cases, the hirer may proceed to claim a refund from their insurance provider, and 4BOX4 Adventure Rentals will furnish any necessary documentation upon request.
In the event that the hirer’s insurance provider is approved by 4BOX4 Adventure Rentals, the security deposit held on a card will be double our standard hold.
If the hirer chooses to utilize 4BOX4 Adventure Rentals insurance, any driver listed in the Rental Document as authorized to operate the vehicle is responsible for the payment of the full deductible amount. For small 4×4 vehicles, the deductible is US$1200, and for large 4×4 vehicles, it is US$1500.
When opting for the 4BOX4 Adventure Rentals insurance, the insurance premium is encompassed within the overall hire charge.
Under 4BOX4 Adventure Rentals insurance, the hirer is liable for the excess as specified in the Rental Document, payable for each incident involving the vehicle. If the damage falls outside the coverage of 4BOX4 Adventure Rentals insurance, the excess will be considered partial payment towards the total damage cost, and any additional costs will be charged to the hirer.
A supplementary Damage Administration fee of $100 will be levied for the processing of damage claims. This fee applies universally to all damage claims, irrespective of whether the hirer selects the 4BOX4 Adventure Rentals insurance or arranges their own. It may be subject to refund upon substantiation that the damage was not caused by the hirer’s negligence.
Exclusions from Insurance Coverage
The hirer acknowledges that the insurance coverage shall not be applicable:
At any time when the driver of the vehicle is under the influence of alcohol or any drug;
At any time when the vehicle is in an unsafe or unroadworthy condition, such condition arising during the course of the hire, that caused or contributed to the damage or loss, and the hirer or driver was aware or should have been aware of the unsafe or unroadworthy condition of the vehicle;
At any time when a mechanical failure, breakdown, or breakage occurs and/or an electrical or electronic failure or breakdown occurs that is the result of improper use of the vehicle. This exclusion also applies to damage to the engine or transmission system directly resulting from any mechanical failure, breakdown, or breakage but does not otherwise apply to resulting damage to other parts of the vehicle;
At any time when the vehicle is driven in any race, speed test, reliability trial, rally, or contest, or operated on any race or rally circuit or in any event as a pace-maker or testing in preparation for any of them;
At any time when the vehicle is driven by anyone not named or described in the Rental Document as a person permitted to drive the vehicle;
At any time when the vehicle is driven by an unlicensed person;
At any time when the vehicle is willfully or recklessly damaged or lost by the hirer, a nominated driver, or a person under the hirer’s authority or control;
At any time when the driver commits a traffic offence while driving the vehicle;
At any time when the vehicle is loaded or is being loaded in excess of the manufacturer’s specifications;
At any time when the vehicle is being loaded or unloaded beyond the limits of a thoroughfare, and such loading or unloading is not performed by the driver or attendant of the vehicle;
At any time when the driver fails to stop or remain at the scene following the occurrence of an accident where required to do so by law;
To any fine or penalty imposed as a result of prosecution for breach of any law;
To any puncture, cut or bursting of any tire, or damage to any tire by application of brakes;
To any wear and tear to the vehicle;
To any liability for damage caused by vibration or the weight of the vehicle or its load to any: bridge or viaduct; any road or anything beneath a road; any underground pipeline or cable; or any other underground installation;
To any overhead damage to the vehicle or to the property of any third party resulting from such overhead damage;
At any time when the vehicle was operated beyond the term of the Rental Agreement or any agreed extension of the term or at any other time or in any other circumstances notified by the owner to the hirer.
At any time when the driver causes water damage by crossing rivers, speeding through bodies of water, lakes, oceans, estuaries, etc. No insurance coverage will be provided for water damages. Water damages are solely the responsibility of the hirer.
Hirer's Utilization of Personal Insurance
If the hirer chooses to utilize their own insurance, they willingly assume full liability for all losses, costs, and damages.
In the event that the hirer uses their own insurance provider, they are accountable for the complete payment of any damages. The responsibility lies with the hirer to claim a refund from their insurance provider, and 4BOX4 Adventure Rentals will furnish any required documentation upon request. If the hirer opts for their own insurance provider, the security deposit on hold on a card is twice our standard hold.
Traffic Offenses and Violations
All penalties associated with traffic and/or parking offenses are the responsibility of the hirer. 4BOX4 Adventure Rentals reserves the right to charge the hirer’s credit card for any infringement fees related to traffic and/or parking offenses incurred by the hirer. Upon receiving notice of such offenses, 4BOX4 Adventure Rentals commits to promptly forwarding a copy of the notice to the hirer and providing the necessary information to the relevant issuing authority for direct communication with the hirer.
The hirer retains the right to contest, complain about, query, or object to the alleged offense with the issuing enforcement authority and is entitled to seek a court hearing. In the event that the court cancels the mentioned offense, 4BOX4 Adventure Rentals will refund any charges incurred.
Additionally, 4BOX4 Adventure Rentals may impose an administration fee of $50 to cover the expenses associated with paying, processing, and sending notices related to traffic and/or parking infringements to the hirer.
Cancellation of Rental Agreement
In the event of the hirer’s non-compliance with any terms specified in the Rental Agreement or damage to the vehicle, 4BOX4 Adventure Rentals reserves the right to terminate the hire and promptly assume possession of the vehicle. Termination under the authority of this clause shall not adversely affect the other rights vested on 4BOX4 Adventure Rentals or the rights of the hirer as outlined in the Rental Agreement or otherwise.
Supplementary Equipment
The hirer acknowledges their responsibility for:
Damage to or loss, including theft, of the WiFi unit and other electronics and/or their accessories $100 for the Wi-Fi Device; and
A handling and freight fee in cases where any electronic accessory is damaged and/or not returned with the unit. The charge is to replace accessories.
Damage to or loss, including theft, of the Camping equipment and Roof-top Tent and/or its accessories. The charge is $1500 per unit; and
A handling and freight fee in cases where any Roof-top Tent accessory is damaged and/or not returned with the vehicle. The charge will be according to the damage/accessory with a maximum of $250.
Damage to or loss, including theft, of the Camping and Sporting Equipment and/or its accessories.
A handling and freight fee in cases where any Sporting Equipment accessory is damaged and/or not returned with the Sporting Equipment unit. The charge varies per accessory.
Damage to or loss, including theft, of any car part or accessory. The charge is based on the replacement cost of said car part or accessory;
Camping Equipment Liability Release
The hirer acknowledges and agrees to the assumption of risk while utilizing camping equipment and engaging in camping activities:
Assumption of Risk: The hirer assumes all risks of injury, death, or property damages resulting from the use of the equipment provided, such as tents, rooftop tents, gas stoves, gas tanks, knives, cooking utensils, machetes, etc., provided by 4BOX4 Adventure Rentals. In the event that an item or equipment appears damaged, in poor condition, or poses a risk, the hirer is obligated to report it immediately and cease its use.
The hirer bears full responsibility for the proper opening, closing, and use of the rooftop tent. In the event that the hirer falls from the ladder, experiences an injury while using the rooftop tent, or encounters issues related to the rooftop tent, the hirer assumes sole responsibility. Caution is advised when ascending and descending the rooftop tent ladder, and the hirer must ensure the ladder is in a vertical position before use. If the hirer feels uncertain about using the equipment, they should request a demonstration from a 4BOX4 Adventure Rentals employee during the vehicle pickup.
As the hirer and their group engage in camping and driving within a natural and unpredictable environment, 4BOX4 Adventure Rentalsdoes not accept responsibility for any damage, injury, or inconvenience caused by plants, trees, insects, wildlife, weather, water, fire, wind, or any natural element or cause. The company disclaims responsibility for any factors outside of its control that may adversely affect the hirer’s holiday. 4BOX4 Adventure Rentals will not be liable for hotel/lodging or meal expenses if the camping environment or climate is deemed unsuitable by the hirer for camping and/or cooking.
In cases where 4BOX4 Adventure Rentals is deemed responsible for the hirer’s loss, the maximum liability shall be limited to refunding the amount paid by the hirer for the rental
Privacy Policy and Confidentiality
The information solicited from the hirer is essential for 4BOX4 Adventure Rentals to evaluate the hirer’s request to hire a vehicle. While the provision of this information is optional, the hirer acknowledges that failure to supply it renders 4BOX4 Adventure Rentals unable to proceed with the vehicle hire. The hirer acknowledges and consents to the collection, retention, and use of their personal information by 4BOX4 Adventure Rentals for purposes directly related to the vehicle hire and the provision of associated customer services. This includes activities such as direct marketing and evaluating customer satisfaction with products and services offered by 4BOX4 Adventure Rentals.
Furthermore, the hirer acknowledges that their personal information may be disclosed to debt collection agencies in the event of default in payment of any monies owed to 4BOX4 Adventure Rentals. Additionally, information may be disclosed to other parties involved in an accident with the vehicle during the hire period or to organizations responsible for processing or handling traffic-related infringements. The hirer expressly authorizes the disclosure of their personal information for such purposes.
HIRER NOTE
4BOX4 Adventure Rentals is required to furnish the hirer with a minimum of one copy of the Rental Agreement. This document must be securely stored within the vehicle for the entire duration of the hire and presented promptly upon request to any enforcement officer.
